These Terms of Service ("Terms") govern your use of the adultproject.agency website and the web development services provided by AdultProject Agency ("Company", "we", "us"). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
AdultProject Agency provides custom web development services for the adult entertainment industry, including but not limited to: website design and development, platform architecture, payment integration, streaming infrastructure, mobile app development, and ongoing technical support. All services are provided on a project basis or hourly rate basis as agreed upon in individual service agreements or statements of work (SOW).
2. Eligibility
You must be at least 18 years of age to use our website or engage our services. By using our website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements.
3. Project Agreements
All development projects are governed by individual service agreements that specify scope, timeline, deliverables, payment terms, and other project-specific conditions. These agreements, along with any associated NDAs, take precedence over these general Terms where applicable.
4. Intellectual Property
Upon full payment for completed work, all custom code, designs, and deliverables created specifically for your project are transferred to you as the client. We retain the right to use general-purpose tools, libraries, and frameworks developed during the project for other clients. Pre-existing intellectual property, third-party licenses, and open-source components used in your project remain subject to their original license terms.
5. Payment Terms
Payment terms are specified in individual project agreements. Standard terms include: • Hourly rate projects are billed bi-weekly based on tracked hours • Fixed-price projects typically require a deposit of 30-50% upfront • All invoices are due within 14 days of issuance unless otherwise agreed • Late payments may incur interest at 1.5% per month We accept wire transfers, cryptocurrency, and other payment methods as agreed.
6. Confidentiality
We treat all client information, project details, and business data as strictly confidential. All projects are covered by Non-Disclosure Agreements (NDAs). We will not disclose any client information to third parties without explicit written consent, except as required by law.
7. Warranties & Liability
We warrant that our services will be performed in a professional and workmanlike manner. All deliverables include a warranty period (typically 3 months post-launch) during which we will fix bugs and defects at no additional cost. Our total liability for any claim arising from our services shall not exceed the total fees paid for the specific project in question. We are not liable for indirect, incidental, or consequential damages.
8. Client Responsibilities
Clients are responsible for: • Ensuring their adult platforms comply with all applicable laws and regulations in their operating jurisdictions • Obtaining necessary licenses and permits for adult content distribution • Providing accurate project requirements and timely feedback • Maintaining compliance with payment processor terms of service • Content moderation and legal compliance of user-generated content
9. Termination
Either party may terminate a project agreement with 30 days written notice. In case of termination, the client will be invoiced for all work completed up to the termination date. Any deposits for unstarted work will be refunded within 14 business days.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable international commercial law. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.
